Attorney General Ford Applauds Sixth Circuit Win in Kalshi Case in Which Nevada Led Amicus Brief

Carson City, NV – Today, Nevada Attorney General Aaron D. Ford applauded a federal appeals court ruling that protects states’ authority to enforce their sports betting laws against prediction market company KalshiEX LLC. On Friday, Sept. 25, the U.S. Court of Appeals for the Sixth Circuit rejected Kalshi’s argument that federal law prevents states from applying their gaming laws to the company’s sports-event contracts. The court found that Kalshi’s sports-event contracts are not “swaps” under federal commodities law. It also ruled that, even if they were, federal law does not override state gaming laws.

Nevada led a multistate amicus brief supporting states’ authority to regulate sports betting and enforce their gaming laws.

“This is another important win for states’ ability to regulate gaming and protect consumers,” said Attorney General Ford. “Companies should not be able to avoid state gaming laws simply by calling sports wagers something else. Nevada was proud to lead states in defending this authority.”

The Sixth Circuit also upheld an Ohio court’s decision denying Kalshi a preliminary injunction and overturned a Tennessee court’s decision that had blocked the state from enforcing its laws against Kalshi.

The decision follows a recent Ninth Circuit ruling that upheld a Nevada federal court decision allowing state gaming regulators to enforce Nevada’s laws against Kalshi.
